Man Convicted of Possession of Firearm While on Probation for Charges Stemming From McKinleyville Home Invasion

Press release from the Humboldt County District Attorney’s Office:Blaine Martin

On December 1, 2016, a jury convicted 24-year-old Blaine Richard Martin of Trinidad of Possession of a Firearm by a Felon and Possession of Ammunition, charges stemming from a routine traffic stop in McKinleyville on March 24, 2016. Mr. Martin was on felony probation for a 2015 conviction for possessing a firearm with the intent to commit a felony when stopped by a Humboldt County Deputy Sheriff; the Deputy searched the vehicle as allowed by Mr. Martin’s conditions of probation. During the search the Deputy discovered a loaded .45 caliber semi-automatic handgun and 20 rounds of .45 caliber ammunition in a plastic case on the front seat.

In addition to the jury’s findings of guilt, the trial judge found Mr. Martin in violation of both his 2015 felony probation, as well as in violation of probation linked to a 2016 misdemeanor conviction for providing a place for the manufacture or distribution of a controlled substance.
All matters have been referred to the Humboldt County Probation Department for pre-sentencing reports and sentencing is scheduled for December 28, 2016. The defendant faces a maximum sentence of 3 years and 8 months. He is currently in custody.

The case was investigated by the Humboldt County Sheriff’s Department and prosecuted by Deputy D.A. Brent Kling. Mr. Martin was represented by the Humboldt County Public Defender’s Office.

No wonder home invasions are on the rise! Probation!? For invading someone’s sanctuary and sticking a gun in their face? Why does Humboldt even have a jail? It’s not really a jail at all, is it? It’s merely a booking facility for a catch-and-release system. I bet the police just LOVE arresting the same felons over and over. Does wonders for their morale. The handcuffs and courts are ineffective. Perhaps that’s the reason that the gun is now their go-to?

The police here spend an inordinate amount of time & energy & money arresting the SAME PEOPLE day after day for being “drunk in public”. They do not seem able to solve any crime where the perpetrator is not on scene when they (the police) arrive. We have an entirely disfunctional law enforcement situation, which coupled with the court system, produces only more crime…see our current murder statistic ….20 so far this year…if you have any doubts.

Law enforcement is hobbled by the various propositions, 47, 57, 64, and so on, that push “sentencing equality” and the fantasy that petty criminals can be, or want to be, honest citizens. Most don’t bother to show up for counseling or job training, they’re too busy stealing and fighting. As for solving crimes, it’s difficult when all the witnesses are friends/family of the perpetrator and refuse to talk. And you’re blaming the homicide rate on the cops? How about the drug culture which enables and perpetuates greed and violence.

Maybe the gun owner that got his safe stolen, or the gun shop that was broken into , or maybe he just bought it from someone overseas and had it shipped. Million ways to get a gun illegally, sheesh

Really?! So giving him probation for an armed home invasion didn’t straighten him out?! I’d blame Gallegos but this wasn’t even him. Okay- the system is broken.
