Man Arrested for Rape at the Red Roof Inn

A little before 2 a.m. on Saturday, Arcata Police responded to a report of a rape at the Red Roof Inn. A woman reported that she had been assaulted by a Riley Gordon Kiesel age 32 from Mendocino County.

“They were acquaintances,” explained Sgt. Keith Altizer of the APD. “It wasn’t strangers.” The man, he said, allegedly assaulted the woman in a motel room at approximately 1:30 a.m. At this time, Altizer would not divulge how the woman managed to get out of the room and contact law enforcement. He said the incident was under investigation.

Kiesel was not allowed bail as he was on parole for Assault with a Deadly Weapon.

In a 2013 article by the Anderson Valley Advertiser, Kiesel was reported to have stabbed a man. According to the Anderson Valley Advertiser,  “Before the stabbing, Kiesel had a record of local arrests going back to 2004, which include charges of carrying concealed weapons, drunk in public and marijuana-related offenses.”

Then in February 2013, Kiesel was arrested on multiple charges after fleeing Arcata Police.

In early 2015, Kiesel fled as the Mendocino Sheriff’s Office attempted to serve a felony arrest warrant from Humboldt County. A manhunt ensued. Eventually, he was arrested without incident.

Apparently, he was released.

Read the article again.

The article clearly states he was released in 2015 after being arrested.
Today’s incident cites “Kiesel was not allowed bail as he was on parole for Assault with a Deadly Weapon.”
The above sentence means he’s still in custody.

No, it does not. He was on parole when the current alleged offense took place. He was not allowed bail because he was on parole when the new offense allegedly occurred. Not a lawyer, but I think that if you allegedly Re-offend while on parole, then no bail since you are already confirmed as a screw-up. It’s not complicated.

i have known this guy since we were 5, he was a good guy, truly, his brother died in front of him and he turned to drugs, then got over dosed at a music festival, with acid laced with meth, he went nuts, and became increasingly violent, his mother is an absolutely amazing, intelligent and kind woman, who did all she could, have a fucking heart and look into the facts before casting stones people!!!!

All we know is that he was arrested for an alleged rape and not allowed bail because he was on parole.

The headline should reflect “alleged rape”….meaning no charges have been filed yet……and no witnesses to the alleged rape is corroborating the statement of alleged victim.

Apparently, since rape is an “unwanted forced sex act perpetrated upon the unwanting or impaired”, all that is needed to arrest on the allegation is evidence that 2 or more people were together at a point where the despicable act is believed to be plausible until proving innocense or guilt at a later date.

This is one of those (give lots of leeway to the alleged victim) crimes that females can get away with using plots to deceive, manipulate for personal gains, benefit (retaliation, vendettas count too), etc… Rape is also an underreported crime, especially with the disabled, impaired and children.

Years ago, as a graduated shit entering college years, HOJ was listening to KSRO radio on the road. Some lady divulged that she was retaliating against men by having sex with men to transfer the aids virus because a man gave it to her…….just about the time the laws recognized that her actions were “threats of deadly use of a weapon”……or something along those lines.

Talk about an eye opener, wtf moment.

Did the cops have the rape test kit, dna test kit, crime investigators, etc…. NOPE!

So the arresting officers “for sure” verified a rape occured?

An allegation is not verification.

It is just overly dangerous to mediaize guilt prior to guilt being proven…..guess the least that could be done is when people accused of rape are not proven to have raped should be mediaized as a victim of a false allegation……ya, the guy reads as a dirtbag, but on a human level, it is a dangerous road to hoe that the more of a dirtbag someone is, the less they should be provided the same considerations of law that all of us are too be provided.

Adding insult to injury (via false charges that rile up any community for prosecution) is a legal scenario not good for all of society.

At this point, it is like playing poker…..the Headline can “bet on guilt” by printing “arrested for rape” or do the right thing(even for dirtbags) and print a headline of “arrested on allegation of rape” because the meat of the story only mentions allegation, and since he was on probation anyway, the guy could have farted up wind and been taken in.

Just being cautious for precedents not in the best interest of a peaceful society that preaches facts and truth over cherrypicking hipocrisy.

Can’t imagine a spun out meth chick going whackjob crazy and making up some bs…..

Absolutely correct and well stated. “Alleged” a correct description of HIS status as the potential law-breaker, just as people are always referred to as “suspects” until they have been convicted in a court of law.

Similarly, the word “suspect” is, unfortunately but understandably, used so often in the media and by law enforcement that many people outside those realms equate them such that “suspect = guilty person.” when in the real world, “suspect” and “alleged” offer a significant degree of protection against libel (or slander) accusations or lawsuits.

Wrong. Entirely, totally wrong.

Got a California Penal Code handy?

§836. (a) A peace officer may arrest a person in obedience to a warrant, or…

“…(2) The person arrested has committed a felony, although not in the officer’s presence….”

OR, now read this next one S-L-O-W-L-Y and carefully so even YOU might understand it:

“(3) The officer has probable cause to believe that the person to be arrested has committed a felony, whether or not a felony, in fact, has been committed.”

See that, “whether or not a felony, in fact, has been committed”? Without needing any overly significant, as-yet-proven evidence, an officer may legally make a felony arrest based on the evidence (often nothing more than statements) that is available to him at the scene at the time.

That power in #3, by the way, is one of very few given to police officers that citizens who aren’t police officers don’t have. For other arrest scenarios, California allows any person to make an arrest for a crime committed in their presence.

And separately, but equally misunderstood by you, the bail referred to in reports of arrest only applies to bail available or not at the time of booking.

When an arrestee appears before the judge for arraignment within the 72 hours or less, the judge can, in most cases, do whatever he or she wants about bail: raise it, lower it, deny it entirely or drop it and let an arrestee go on their own recognizance pending trial. And the bail issue can always be revisited in the time between arraignment and trial as circumstances change.

Being arrested for “Rape”, or whatever with the very little known facts the story provides, can be a misrepresentation of the facts making for a false arrest potential.

The guy reads as a dirtbag(undeniable), but it does not mean the allegation is true until we all know it has been proven as true.

HOJ understands the law because HOJ has been subjected to false arrests, police brutality, defamation of character, libel, slander, misrepresentation, slam jobs by media and political wannabees and people who have yet to observe the facts. HOJ has done much research too, so just sayin…..

As for actual rape, it is evil, as HOJ has always championed.

The accused is a single person, no one as a witness for benefit of the “set up for a fall” attempt upon victim. Scenario is a 3 versus 1 where the LEO now has the power and authority to arrest because eyewitnesses suppisedly exist, but liars are not eyewitnesses. Proving the arrest to be false because of the leeways given only happens after the false arrest. Verification of false arrest occurs when the DA does not file charges because the allegation does not align with facts….then mommy dearest reaped karma when her own insurance company had to break the news that evidence exists that proves mommy dearest lied in order to have a person falsely arrested under the guise that the allegation concocted was believeable……whats that saying, “ya just cant make that stuff up…..”.

Now, scenario is 1 versus 1, where no witnesses exist and either person can make up a bullshit story.

Can you imagine a woman getting upset, throwing a tantrum, verbally threatening the guy with her concocted threats as a way to control, as well as, save face for the prediciment or embarrassment of the situation, psychological punishment? It happens more often than noticed…..like the underreported rapes of minors, disabled, impaired.

The silly thing is all you bloggers who charge HOJ as “pro rapist”, when all HOJ is cautioning as a concerned citizen is “Rape implies guilt”……”the guy aint even guilty yet”……it is a chronological order proposal for facts to prove guilt, not a headline betting on guilt.

HOJ is being humane and reasonable……. HOJ has yet to cast blame, but raises “what if” thoughts.

Kym, we agree to disagree, no worries, right?

Would it be disrespectful to request that from this point going forward, you only use “alleged” and then update that with another story to confirm allegation as guilty or innocent?

If simply being anywhere at any time is enough for a person to be set up for a fall in a conspiracy of an allegation by another for whatever, then it is prudent to commemorate the falsely accused with a headline that conveys not guilty or innocense because allegations were false?

This is less information in this allegation, and a person is arrested…..

Then, there is a situation with lots of information, but no arrest and two young females killed (aka were no less than manslaughtered/felony hit and run causing 2 deaths).

HOJ suggests take all his comments, prepare a document to send off to the human rights commission of Humboldt County, California (for anyone who thinks they are in the midwest).

Commission verdict : HOJ raises a valid concern, did no wrong in raising the concern, and that by virtue of raising a concern, that HOJ’s concern is not an actual belief that rape is anything other/else but evil or a legal age mandate.

I’ve known Riley for a long time, since elementary school. It saddens me that he was arrested on alleged rape charges, but it does not surprise me. It was also sad when he stabbed a good friend of mine and awesome local bartender. There was a time, long ago, that he was sweet, but at some point, something broke in that kid. It blew my mind when I ran into him at the grocery store a mere 6 months after stabbing my friend. Six months for attempted murder? Really? Riley has a history of violent crimes. He should be put somewhere where he can’t hurt anyone else, and where he can get the mental health help that he needs….. for a long time. Six months, a year, won’t cut it. He needs a slap across the face, not on the wrist.

I’ve known him since I was 15. This doesn’t surprise me. When I first met him I thought he was nice but he became stalkerish. I’m glad I caught the feeling that he was a creep. He’s been in and out of jail, stabbed a friend of mine and now this. How he keeps getting released is beyond my comprehension. He really needs to be put away for a very long time with no chance of getting out. He’s clearly not mentally well and is a danger to others. Insane! He’s going to keep getting worse if someone doesn’t stop him!

he is now currently my roommate, and he is nice, courteous, has made me coffee a few times. Just wish he’d clean up after him self in the kitchen. He seems to be really mellow and chill. Whatever has happened in the past, I think he has gotten some healing or has grown up. He’s now in his early 30s, hes not an angry boy anymore, he is settling into being a nice man. He has full time job and always pays his rent and never bugs me with BS. he’s handsome too. I’ve been trying to seduce him, but he won’t touch me.
