Fortuna City Council Adopts New Ordinances

City of Fortuna BlurThe Fortuna City Council met last Monday, 5-16-16, for their regular meeting.  You can see the full agenda packet here.  The packet includes reports from the Chamber of Commerce, Fortuna Business Improvement District, monthly reports from Finance, Parks and Recreations, FOPD, River Lodge, Monday Club, and a packet on pending litigation against the City over a skateboarding accident (police report included).

Highlights from the business portion included adoption of a resolution involving the City’s Associate membership in the California Home Finance Authority in regards to the PACE Programs (Property Assessed Clean Energy).  According to the Redwood Coast Energy Authority website, “Property Assessed Clean Energy (PACE) is a program that authorizes a local government to provide up-front funding to eligible property owners to finance the installation of energy efficiency upgrades, water conservation improvements and renewable energy systems on their property. PACE can pay for new heating and cooling systems, lighting improvements, solar panels, water pumps, insulation, and more for almost any property- residential, commercial, industrial, non-profit, and agricultural. The programs are 100% voluntary. Property owners repay the local government’s funding by agreeing to an assessment levied against their property, which is payable on their property tax bill.”

A local real estate agent cautioned that such liens against properties could cause issues with Fannie Mae and Freddie Mac lenders as they will not always refinance or loan on properties with a PACE lien.

Another item to note, a second reading and adoption of 2016-724 was performed.  This new ordinance added section 9.28.035 and amended sections 9.28.040 and 9.28.050 of Chapter 9.28 of Title 9 of the Fortuna Municipal Code regarding unlawful solicitation.  This portion of the ordinance now makes it illegal to give items to pedestrians, from a vehicle located on a roadway.  People wishing to hand items off to pedestrians must do so off of the roadway and legally parked.  This ordinance was created around the same time as the new ordinance restricting aggressive panhandling within the city limits of Fortuna.  You can read about this portion of the ordinance here.

think fortuna VFD used to have an annual boot drive , standing in the road asking for donations for various reasons . how is new sorta panhandling gonna affect their fund raising
