DUI, Pistol, Pipe, and Warrant Land Eureka Resident in Jail, Says APD
This is a press release from the Arcata Police Department. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:
On 3/19/2016 at about 1:00am, an officer with the Arcata Police Department conducted a traffic enforcement stop in the 1200 block of I Street for a registration violation.
The driver of the vehicle, identified as Eureka resident Michael Anthony Koenig (age 38), was placed under arrest for DUI incident to the officers investigation. Koenig was additionally booked for an outstanding arrest warrant for DUI.
During a search incident to his arrest, a loaded .45 caliber semi-automatic pistol was located between the two front seats of Koenig’s vehicle. A glass methamphetamine pipe was also located on his person.
Koenig was transported to the Humboldt County Correctional Facility where he was booked and lodged for CVC 23152(a) – DUI, PC 25850(a) – Carrying a Loaded Firearm in Vehicle, PC 29800(a)(1) – Convicted Felon in Possession of a Firearm, CVC 14601.2(a) – Suspended License and H&S 11364(a) – Possession of Paraphernalia.

Did the guy have a search and seizure Clause if not it was illegal search and seizure but he was probably on probation and has a the search and seizure clause
Did you read the press release. He was arrested for dui and incidental to the arrest the vehicle was searched and the firearm was located. No illegal search. Hope you pay more attention if you ever serve on jury duty.
Not to mention he was already on felony probation.
Read the post again, slowly. If this is your perception of reality, you are one walking bust waiting to happen. As a “lawyer”, you have a fool for a client.
I bet they didnt keep him in jail. Just a revolving door . They should print whos kept and whos released due to over crowding.
If he doesn’t have a violent past it’s better to risk a flight to avoid prosecution, than to take up jail space that would be much better utilized if filled with a violent gang member. Besides if we’re lucky he’ll flee the area and be picked up and prosecuted in another county that can more afford it.
He is still in jail probation hold he probably has a suspended sentence hanging over him ,for a prior conviction, so yes to your question he’s still in jail.Can’t bail with probat ion hold .
