Man Arrested in Mall With Airsoft Gun

Dexter, DanielOn 03/17/16 at about 9:45 a.m., Officers with the Eureka Police Department responded to the 3300 block of Broadway for the report of a male inside a mall store with what appeared to be a large firearm in his jacket.

Upon arrival, mall security advised officers that the male was walking south through the mall foyer. Officers located the male and took him into custody without further incident. The male was identified as Daniel Dexter, 29 of Eureka. Dexter was found to be in possession of an AR-15 replica airsoft gun and brass knuckles.

Dexter was transported and booked into the Humboldt County Correctional Facility for possession of brass knuckles and public intoxication.20160317_112058

    • Because the people who asked me to look into it weren’t worried about the brass knuckles which couldn’t be seen but instead they were worried about the Airsoft gun that could be seen.

  • Air soft Guns are not illegal to transport unless you are displaying them in public areas .That is a brandishing charge . If he didn’t try to brandish it he would probably be able to beat the charges due to the obvious orange tip which is to signify to anyone who would be concerned that it is a replica and he didn’t point it at anyone or try to expose it in public . That’s probably why there’s no charge for anything related to the air soft gun . Remember replica rifles don’t all have orange tips ! BB guns are exempt and any replica used for theatrical purposes or for re enactments as well as for rodent extermination. All if which are legal in California to own and transport . Just don’t go pointing them at people unless involved in a reenactment or sport . keeping them in your waistband where there is reasonable suspicion it may be real could get you shot !
    knowing that it’s not illegal to own and transport a BB gun or air soft gun once the officers saw it was a legal toy he could have walked free had he not been intoxicated.
    The mall has a no handgun policy but it is a small and insignificant sign that had nothing but a symbol representing pistols . Looks like he had a rifle that was under his coat where he attempted to conceal it . One could argue he wasn’t even violating the malls own rules as they are posted to the public .

    There was no logical reason for the man to have hidden in his coat a weapon. Yes it may just be an AirSoft replica, but really?
    He is reported to of been drunk.
    For the folks who saw his weapon peaking out from his coat, they could not see an orange tip on the barrel.
    Sheesh….the man obviously has issues and I have to say the photo of him suggests some major medical issues.
    Wonder if he had a stroke due to the grimace on his face.
    Or maybe he had to use the restroom?
    He is very lucky that a concealed carry holder did not get to him before the EPD.
    Guess he did not read the signage that states that weapons are not allowed on mall premises.

  • I’ve been telling people this was going to happen….nobody ever listens..kid needs to be in a facility.

  • I have been trying to get anyone to listen…I could tell horror stories about this guy…he needs a medical facility..and anyone who has given him drugs or alcohol should be ashamed… he’s got Holden Caulfield syndrome… I warned people he wanted to kill someone… sitting in his house with a bandana over his face listening to ” how I could just kill a man”by rage against the machine on repeat with that stupid air soft gun…for hours…
