A New Day? Humboldt County Government Invites Cannabis Businesses to Get Permits

A new day….? Cannabis and deer, growers and government?

Beginning on Friday, Feb. 26 you can take part in making history by applying to have your medical marijuana business permitted in the unincorporated areas of Humboldt County. On this day, our Commercial Medical Marijuana Land Use Ordinance will take effect, making Humboldt the first county in the state to develop a comprehensive local regulatory system that is in line with recently passed state law.

On Jan. 1, the Medical Marijuana Regulation and Safety Act (MMRSA) took effect, and provided a statewide regulatory framework whereby those who obtain both a local and state permit can legally engage in a variety of activities involving commercial production, manufacturing, and distribution of medical cannabis in California. While you will be able to apply for your local permit on Friday, once the state begins issuing licenses you will need to get those as well. However, those who are considered to be in good standing with their local jurisdiction will be first in line for those licenses.

“As the new state laws come online, cannabis growers and other businesses will only be able to operate legally in California if they are licensed and permitted at the local level,” said Mark Lovelace, Chair of the Board of Supervisors. “Humboldt County is leading the state right now, so those businesses which get their permits early will not only be ahead of the curve legally, they will also be well-positioned in this emerging marketplace.”

These regulations were put into effect to reduce environmental impacts, to help ensure local control and to convert an underground, black-market economy into a legitimate agricultural and commercial contributor to the local and state economy. By applying, you are not only ensuring that your business is operating in accordance with the MMRSA and county regulations, you are also demonstrating that you are a responsible business owner and member of our community.

The permits you will be able to apply for are as follows (full definitions can be found in Humboldt County Ordinance No. 2544):
marijuana• Cultivation: Planting, growing, harvesting, drying, curing, grading, or trimming of marijuana for medical use. Permits are broken down into indoor, outdoor, mixed light and nursery cultivation.• Manufacture: Transforming the raw agricultural product into a medical cannabis product
• Distribution: Location or facility to procure medical marijuana for sale to dispensaries, and the inspection, quality assurance and batch testing of the product prior to transport.

To apply for your permit, visit the Planning & Building Department beginning at 8:30 a.m. on Feb. 26 at 3015 H Street in Eureka.

• The department has also established a dedicated 24-hour hotline for questions concerning the Commercial Medical Marijuana Land Use Ordinance. Call them at 707-268-3795. During regular business hours, dedicated staff will be available to answer questions and return calls.

“This is an exciting time for Humboldt County, and it’s an honor to be able to serve our citizens in this historic new process,” said Robert Wall, Director of the Planning & Building Department. “This is new ground for everyone, so there are bound to be some bumps in the road. However, we are dedicated to making this successful and supporting applicants in any way possible. We want to make sure you have everything you need and answer any questions you have during the permitting process.”

The hard work of both our Planning & Building Department and our County Counsel’s Office allowed us to pass these regulations before any other county in the state. More regulations are still being developed.

Beginning Feb. 26, the application process will only be open to activities outside of the Coastal Zone. New regulations within the Coastal Zone await review and certification by the Coastal Commission before they may take effect. Unless extended by the Board of Supervisors, the period for accepting applications will close on December 31.

beautiful deer
did you know that if a pot farm is perfect legal with license and everything LEGAL
they can get depradation ( i cant spell ) permit to kill all those pot loving deer and all other animals that eat pot .
its just a thought i had cause a friend used to grow grapes in hopland and he could kill all animals that entered his property , birds and deer .
and if pot is legal as a crop , any legal owner can get same permit from fish & wildlife

I have a better idea. It’s called a fence. Even a fence isn’t always necessary considering that deer don’t always eat pot plants. Apparently the ones in this picture haven’t been interested in those plants right next to them.

And did you know…you don’t even have to erect the fence. Just laying the deer fencing on the ground around your garden will keep most animals with hooves away. Because they think they’ll trip on it or get entangled. It works. Try it and thank me later. No more driving t posts. 😎

This works. Same principle as cattle guards. All personnel must be aware or people will be tripping and falling flat on their faces. Especially at night.

Deer numbers are way down from the ’70’s. They are more in balance with their food supply and don’t focus on cannabis much, if at all. Six foot fences for small gardens, eight for large. Do not use peanut butter on your rodent traps, only whole, rubber-banded peanuts. The butter draws deer and other critters from a distance. Martens and Fishers are carnivorous, they are your friends. Plenty of other tricks, but I need to be on a panel.

I’m with you on the whole peanut ( in the shell) method for rat “traps”, but instead of a rubber band I use one drop of super glue. Works great to use the trap multiple times with the same piece of bait.

as i skim through the permit information pages, i have yet to see a fee schedule. does anyone have an idea on the costs of these permits?

The state license will be 2 dollars a sq ft yearly for cultivation permit, no word yet on cost of county permits.

Read the proposed taxation bill it includes the 2 dollar a square foot licensing scheme.

It’s about freedom. What I want for the end of prohibition is simple, just eliminate all criminal penalties for the cultivation, possession, sales and transportation of cannabis, that’s it. Free the weed, this is what I and many others have been working for ever since Prop 19 way back in 1972, 44 years ago. There are plenty of laws already on the books to deal with environmentally destructive agricultural practices without inventing more. No permits or licenses are required to grow corn, peas or hay.
Local control is minority rule, designed to take freedom from the majority, and stifles free enterprise.
One must ask why are we letting the prohibitionists make up robust, discriminatory, monopolistic corporate rules for the rich, designed to kill the small organic farmer. Small farmers pay taxes on their crop, it’s called income tax!! Prohibitionists and politicians have proved over the last 100 years that prohibition, no matter how well intended, always creates crime, criminals and victims, and protects no one but the rich. It’s time to free the weed, free the people, let freedom ring in this country known as freedom. Just say NO to the re-criminalization of cannabis under the guise of legalization. Just say NO!

If it IS $2.00/sf (and the County will throw in an additional, asinine fee), let’s expand that out to a simple 20 x 40 greenhouse in Willow Creek. $1,600.00. How you going to divine whether you’re growing lettuce in half of it or ganja? Who will oversee all this? The Sheriff? For the sole purpose of revenue generation? This is all set up for the big boys. The Walmarts and McDonalds. Back underground goes the quality. Watch the penalties for ignoring the permitting and taxation become greater than the “old” criminal penalties. I have to agree with “RIP Humboldt.”

It’s a shame the county is promoting commercial pot growing in the last vestiges of nature. Read the articles about the destruction being caused by commercial growers. It’s also a shame that the greedy and destructive lumber industry attracted so many knuckle-dragging dummies to work for them. When they went out of business the dummies had no future and weren’t smart enough to move some place where they could get a job. Leaving a county so desperate to generate income they will encourage destruction of their lands and rivers and streams as well as the fishing industry.

Excess of elements to pot,those that humans need,are causing HAB.toxic algae.i read NPK produces THC tips pound for pound.cant fight big money and lies.poor fish.complete element supplementation causes radical and unintentional algal blooms.NPK also,but those elements your children need.to river? For money? I know this as I bloom algae on ancient inland phytoplankton and see spectacular bloom.and I feed algae to bugs and mammals.
