Fight Leads Deputies to Grow, Says Sheriff’s Office

This is a press release from the Humboldt County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

201504916 Fugini-LawsOn Tuesday, October 13, 2015 at about 3:30 p.m. the Humboldt County Sheriff’s Office received a call of a physical fight between a man and a woman at a residence on the 40500 block of Hwy 299, Willow Creek. It was reported that one of the subjects had a baseball bat.

Deputies arrived on scene and requested entrance to the house to check on those reported fighting. The subject who answered the door, arrestee Alexander James Fugini-Laws, age 24, of Willow Creek, refused deputies entrance to the residence. Deputies explained they were only there to check on the report of a physical fight and not there for the marijuana garden that was visible from the road. Fugini-Laws refused and stated deputies were not allowed entrance without a search warrant.

Deputies contacted the Humboldt County Drug Task Force and a search warrant was issued by the Humboldt County Superior Court. They contacted the individuals fighting and determined it was a verbal altercation only. Located on the property was 338 growing marijuana plants, 330 drying marijuana, and packaging materials.

Alexander James Fugini-Laws was arrested for HS11358 – Plant/Cultivate/Harvest Marijuana, and HS11359 – Possession of Marijuana for Sale. Fugini-Laws was transported to the Humboldt County Correctional Facility and booked on the above charges. His bail was set at $75,000.

Hate Paul Gallegos if u want, but he wanted domestic abuse and other such problems to be reported without fear of being busted for a grow at same time. People never used to call cops at all, which was especially hard for abused women. When he was DA folks actually started calling for help. I guess our new DA has not adopted that policy. Too bad. I would bet a case like this wont make it to trial as plant numbers are small, so really just a shake down to get this guys money while meth heads and other scary foljs run free. I would much rather have them patrolling places like the fortuna vet who had their place vandalized and horses let out into traffic.
Stories like this will deter calling for help. The cops say they cant arrest anyone for assault unless there’s a “weapon” involved, so with no baseball bat there would have been no arrest anyway. Someone I know was attacked in her home by someone she knew who literally tried to break her neck&slammed her head against the wall&floor. Big scary scene. Cops rolled in, girl perp said she didnt recall beating other woman, and since she had no “weapon” there was no arrest or anything. Time for vigilante justice I suppose, not arresting perps like that lets them know they can pummle someone&get away easy.
If only they busted meth labs instead!!! Yes some people use toxic stuff to grow pot, but every single meth lab is a chemical nightmare, &are polluting our land and waterways with toxins that make rat poison look like nothing.

The grow was visible from the road (the state highway?). There were more than 338 plants. The grow was never investigated all year by our county sheriff. This is why the situation has become completely out of control- the sheriff cannot be bothered to do his job in regards to weed. He is lazy and corrupt. So are his deputies. This is why people come here from around the world to blow up scenes and then proceed to act badly. For 15 years there has been virtually zero check on this absurdly dangerous tendency to let criminals finance their socially destructive activities with large amounts of weed money. 25 plants- sure. 50 plants- maybe. 350 plants visible from a major road= no! C’mon Sheriff-You are the problem.

90% of grows are busted because of actions of foolish growers. If you are someone who regularly acts out your chances of being busted are exponentially higher than those of your calm collected neighbors. You can drive up 299 and see dozens of grows. Most won’t be bothered unless the homeowner gets out of hand or supplies a rat that gets pulled over on their way outta town. Calm down and carry on w/ little concern.

Thank you kymkemp for not using the same or similar title as Lost Coast Outpost! It was appalling the extent of their writer’s naivete about dealing with the police attempting to enter your home. Regardless of whether there was a crime being committed or not, the citizen always has the right to deny them entry until a search warrant is obtained but the fuzz obviously had NO intention of leaving without arresting someone for something. The title “Willow Creek Man Arrested on Weed Charges After Basically Begging Deputies to Get a Search Warrant, Sheriff’s Office Says” is totally misleading and not an accurate title for this particular story. Its not illegal to know your rights- please keep in mind I’m not arguing the subject’s innocence but this is a prime example of the police manipulating the law and using it against the public. He was using the only tactic we’re given in this country to protect ourselves against the police which is “knowing your rights” and assuming the police were being honest when claiming they we’re not interested in the grow and the domestic violence report only is the definition of “assume”! I will no longer be reading the lost coast outposts news reports and stick to your site instead. This has not been the first time the lost coast outpost has shown a lack of unbiased journalism and disregard of the facts.

That is a fact, if the guy had let the cops come in at first request, they probably would still have busted him, and everyone would be saying “why did the dumb ass let the cops in without a warrant”.
