Got a 215? Then You Can't Have A 22 or…
A week ago, the Bureau of Alcohol, Tobacco, Firearms, and Explosives issued a letter that said all medical marijuana card holders may not own a gun. To quote, “…if you are aware that the potential transferee is in possession of a card authorizing the possession and use of marijuana under State law, then you have “reasonable cause to believe” that the person is an unlawful user of a controlled substance. As such, you may not transfer firearms or ammunition to the person… .”
Of course, this is unlikely to stop country folk from possessing a gun but it will give the legal system one more hammer to hit a grower with.

A new legislative proposal would declare that the state’s local county sheriffs are the pre-eminent law enforcement authority in their jurisdictions, and federal agents such as those working for the Internal Revenue Service, Federal Bureau of Investigation, Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and others, would be required to get permission from them before they could take any action. The Emperor Wears No Clothes. The absurdity of ATF’s letter is evident. I’ve never been questioned by a gun dealer as to whether I had a 215. The questions are on the form and it’s up to the individual in California to interpret that they are not illegally using a controlled substance.
Seems like another round of hot air to be ignored that’s part of the campaign by the Department of Injustice in D.C. to bully California. Remember the threatening letter from the U.S. attorney this summer?
What seems to be working is the unspoken policy of don’t ask-don’t tell. Anything more than a token enforcement of this would have serious political blowback and become an election issue. I just see it as a scare tactic, because this is not a fight they can win.
Federal Laws trump State Laws according to the Supreme Court, yet here we are 15 years after the passage of Proposition 215 in California with a 56% voter approval and the Federal government has yet to mount a serious challenge. It’s too politically risky for the Obama administration to upset the most populous state with 55 Electoral College votes and 53 Congressional representatives at stake.
